§ 11-97. Redemption; removal and storage charges generally.

  • (a)

    Before the owner or person entitled to the possession of a vehicle or other object impounded under this article shall be permitted to remove it from the custody of the sheriff's department wherever stored, he shall furnish written evidence of his identity and his rights to possession of such vehicle or object, shall sign a receipt therefor and shall provide the sheriff's department with a receipt showing that all towing charges, and if the vehicle or other object is stored at a private storage facility, all storage charges, have been paid.

    (b)

    When the owner or person entitled to possession of a vehicle or other object impounded under this article allows it to remain in storage in excess of twenty-four (24) hours, he shall pay the operator of the place of storage, or to the county, if the same has been stored on county-owned property, a charge of three dollars ($3.00) per day for additional time of storage.

    (c)

    The costs of towing and storage provided for herein shall constitute a lien on the vehicle or other object, and the county and the operator of the place of storage are authorized to retain possession of such vehicle or other object until such charges are paid.
