In order for a parcel to be eligible for a conservation easement, it must meet the
following criteria: (i) the parcel must be completely unencumbered; (ii) the use of
the parcel subject to the conservation easement must be consistent with the comprehensive
plan; (iii) the proposed terms of the conservation easement must be consistent with
the minimum conservation easement terms and conditions set forth in section 5.5-35, unless modified by the board; and (iv) the parcel must be located in the County
of Franklin.
