The Smith Mountain Lake Policy Advisory Board shall develop policies and procedures
for review of such applications which shall include a procedure for notice to the
public and a public hearing; however, such policies and procedures shall provide that
the policy advisory board itself shall not initiate an application for removal of
no-wake buoys lawfully in existence as of the date of this article unless there has
been a substantial change in the conditions which led to the approval for the placement
of said buoys, but subject to review according to the regulations of the state department
of game and inland fisheries and approval by the county board of supervisors. Otherwise,
the policy advisory board shall develop policies and procedures which are subject
to the approval of the county board of supervisors.
