§ 11-100. Sale generally.

  • (a)

    Any vehicle or other object removed from the highways or public grounds and placed in storage in accordance with this article may, if the same remains in storage for a period of more than ninety (90) days and the cost of removal and storage is not paid within such period by the owner or other interested person, will be sold at public auction by the sheriff. Prior to any such sale, the sheriff shall:

    (1)

    Publish notice of such sale for two (2) consecutive weeks in a newspaper of general circulation in the county.

    (2)

    Give not less than five (5) days' notice, in writing by mail to the registered owner and any lien holder or any claimant of such vehicle or object, if the names of such persons are known or are of record in the office of the state division of motor vehicles.

    (b)

    Out of the proceeds of any sale under this section, the costs thereof, together with the cost of removal of such vehicle or object, investigation as to ownership and liens, notice and sale shall be paid, and any balance remaining shall be paid to the person entitled thereto, if known, or if unknown, shall be paid by the sheriff into the county treasury, there to be held in a special account subject to claim by the lawful owner for a period of not more than two (2) years and thereafter, if unclaimed, transferred to the general fund of the county.
