§ 5.1-16. Minimum channel capacity and provision of access channels.

  • It is agreed that the grantee will proceed in an expeditious manner in complying with the provisions of this section; such compliance to be completed within two (2) years of the granting of this franchise.

    (a)

    Grantee's cable television system will operate with at least twenty-channel capacity, which provision may be waived in writing by said board for five-year intervals.

    (b)

    Grantee's cable television system will be capable of providing bandwidth for nonbroadcast uses equivalent to the bandwidth used for broadcast purposes.

    (c)

    Grantee's cable television system shall have technical capacity to enable it to provide nonvoice return communications upon installation of additional equipment not requiring rewiring of the cable television system.

    (d)

    Grantee's cable television system shall maintain at least one (1) specially designed noncommercial public access channel available on a first-come, nondiscriminatory basis. This system shall maintain and have available for public use the minimal equipment and facilities necessary for the production of programming for such a channel. One (1) such channel will be made available without charge, except that production costs may be assessed for live studio presentations. Such production costs and any fee for use of other public access channels shall be consistent with the goal of affording the public a low-cost means of television access.

    (e)

    Grantee's cable television system shall maintain a specially designated access channel for use by local educational authorities. This channel shall be made available without charge.

    (f)

    Grantee's cable television system shall maintain a specially designated access channel for local government use. This channel shall be made available without charge.

    (g)

    Grantee's cable television system shall offer its excess channel capacity for leased access services, and on one (1) of the leased channels, priority shall be given to part-time users.

    (h)

    Whenever all of the channels described in paragraphs (d), (e), (f) and (g) of this section are in use during eighty (80) percent of the weekdays (Monday through Friday) for eighty (80) percent of the time during any consecutive three-hour period for six (6) consecutive weeks, grantee's cable television system shall, within the limits of its channel capacity specified in paragraphs (a) and (b) of this section and if consistent with the then-applicable FCC rules and regulations, have six (6) months in which to make a new access channel available for any or all of the purposes for which said channels are designated.
