§ 5.1-3. Definitions.

For the purposes of this chapter, the following terms, phrases, words, abbreviations and their derivations shall have the same meaning given herein:

(a)

County shall mean the County of Franklin, Virginia.

(b)

County board of supervisors shall mean the present governing body of the county or any successor to the legislative powers of the present county board.

(c)

CATV or community television system shall mean a system employing antennae, microwave wires, wave guides, coaxial cables, or other conductors, equipment or facilities designed, constructed or used for the purpose of:

(1)

Receiving, modifying, collecting and amplifying local or distant broadcast television, radio or other electrical signals for the purpose of distributing or transmitting same by wire, cable or other means to subscribing members of the public;

(2)

Transmitting original cablecast programming not received through television broadcast signals;

(3)

Transmitting television pictures, film and videotape programs not received through broadcast television signals, whether or not encoded or processed to permit reception by only selected receivers; provided, however, that any of the services permitted hereunder to be performed, as described above, shall be those performed by the grantee for subscribers, as herein defined, in the operation of a cable television or CATV system franchised by the county and not otherwise;

(4)

Such terms shall not include any such facility or system that serves only the residents of one (1) or more contiguous apartment dwellings under common ownership, control or management, and commercial establishments located on the premises of such dwellings, and shall not include any system which serves fewer than twenty (20) subscribers;

(d)

Person shall mean any person, firm, partnership, association, corporation, company or organization of any kind.

(e)

Applicant shall mean any person submitting an application to the county for a franchise to operate a cable television system under the terms and conditions set forth by the board of supervisors.

(f)

Grantee shall mean the person to whom or to which a franchise is granted by the county board of supervisors pursuant to this chapter or any one who succeeds such person in accordance with the provisions of the franchise.

(g)

Gross subscriber revenue shall mean subscriber revenues derived from subscriber services, i.e., the carriage of broadcast signals and/or required nonbroadcast services provided by cable television systems pursuant to rules and regulations of the Federal Communication Commission.

(h)

Federal Communication Commission or FCC shall mean that agency as presently constituted by the U.S. Congress or any successor agency.

(i)

Certificate of compliance shall mean that approval required by the FCC for a grantee of a cable television franchise.

(j)

Franchise area shall mean the territory within the county throughout which grantee shall be authorized pursuant to this chapter to construct, maintain and operate a cable television system.
